Refund, Cancellation, and Adoption Terms Policy 

1. INTRODUCTION
This Refund, Cancellation, and Adoption Terms Policy (“Policy”) constitutes a legally binding agreement between you (“you”, “your”, or “User”) and NeuralFin Pty Ltd (“NeuralFin”, “we”, “our”, or “us”) governing your purchases of symbolic shark adoptions and donations through our websites, applications, and related services (collectively, the “Services”).
By making a purchase or donation through the Services, you confirm that you have read, understood, and agree to be bound by this Policy, along with our Terms of Service and Privacy Policy.
2. DEFINITIONS
For the purposes of this Policy:
  • “Symbolic Adoption” refers to the purchase of a symbolic digital certificate representing support for the protection of a shark, without conferring ownership or custodianship rights.
  • “Donation” refers to a voluntary transfer of funds to NeuralFin with no expectation of goods or services in return, other than general donor acknowledgements where applicable.
  • “Digital Product” refers to the PDF adoption certificate or any other intangible product delivered electronically.
  • “User Content” has the meaning set out in our Terms of Service.
3. ADOPTION TERMS
3.1 Symbolic Nature
  • All shark adoptions offered by NeuralFin are strictly symbolic in nature.
  • Purchase of an adoption does not grant ownership, custodianship, possession, or legal rights over the adopted shark, its habitat, or any related biological or ecological data.
  • Adopted sharks remain in their natural environment under the management of local marine ecosystems and authorities.
3.2 Purpose of Symbolic Adoptions
Symbolic adoptions support NeuralFin’s:
  • Marine conservation, protection, and monitoring initiatives
  • AI research and identification system development
  • Community education and citizen science engagement programs
3.3 Adoption Package
Upon completing an adoption purchase and receipt of payment, you will receive:
  • A digital PDF adoption certificate, issued in your name or your nominated recipient’s name, sent via email to the address provided at checkout
  • Species, identification code, and where available, last known sighting information
NeuralFin reserves the right to update certificate designs or included informational details without prior notice.
4. REFUND POLICY
4.1 Digital Products (Adoption Certificates)
  • Due to the intangible, irrevocable nature of digital products, all adoption certificate purchases are final and non-refundable once delivered, except where required under Australian Consumer Law or other applicable law.
4.2 Errors or Non-Receipt
If you do not receive your certificate, or it contains incorrect details (e.g. misspelt names):
  • You must notify NeuralFin within 7 calendar days of purchase by contacting neuralfin.org@neuralfin.org with:
    • Your full name
    • Contact email used for purchase
    • Order confirmation or adoption ID
    • Description of the issue
  • NeuralFin will investigate and, where applicable, reissue a corrected certificate at no additional cost.
Failure to notify within this timeframe may result in denial of reissue requests, except where required by law.
4.3 Donations
  • All donations are non-refundable.
  • Donations are allocated immediately upon receipt towards NeuralFin’s operational costs, conservation programs, and research initiatives.
If you believe a donation was made in error (e.g. duplicate payment), please notify us within 48 hours of the transaction by contacting neuralfin.org@neuralfin.org. Refund requests after this period may not be processed, except where required by law.
5. CANCELLATION POLICY
5.1 Digital Adoptions
  • As certificates are generated and delivered automatically upon payment confirmation, cancellation requests cannot be honoured once processing has commenced, except where required under Australian Consumer Law.
5.2 Donations
  • Donations cannot be cancelled once processed, due to immediate fund allocation.
6. DISCLAIMERS
6.1 No Scientific Certification
  • Adoption certificates are provided for symbolic and informational purposes only and do not constitute scientific certifications, tagging confirmations, or proof of direct biological association.
6.2 Limitation of Liability
To the maximum extent permitted by law:
  • NeuralFin shall not be liable for any indirect, consequential, incidental, special, punitive, or exemplary damages, including but not limited to loss of profits, goodwill, data, or other intangible losses arising from or relating to:
    • Your purchase or use of adoption certificates
    • Your donation transactions
    • Errors in certificate details or delivery failures beyond NeuralFin’s reasonable control
  • NeuralFin’s total liability to you shall not exceed the total amount paid by you for the specific adoption or donation giving rise to the claim.
7. STATUTORY RIGHTS
Nothing in this Policy excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law) or other applicable law that cannot be excluded, restricted, or modified by agreement.
8. GOVERNING LAW
This Policy shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law principles. Any disputes arising under this Policy shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
